#1. Service Payment and Cancellation Policy:

Due to the volume of clients and our standard for human-dog quality time, we have to adhere to a schedule to complete everyone’s service efficiently and on time.

All sessions and programs payments are non-refundable once the session/program has begun and thereafter. To reserve services, payment in full is required at scheduling. Payment for all services is done via bank transfer on receipt of the invoice. You acknowledge and accept that any services provided by PAWS & TRAIN will not be completed until full payment of the service.  Payment of the invoice must be made in full at least 2 business days prior to the commencement of the training session or program. If you have failed to make the full payment to us at least 2 business days prior to commencement of the service, your registration may, at our sole discretion, be cancelled.

If the student fails to give at least 48h of rescheduling/cancellation notice or is not present at the time of the scheduled appointment that session will be forfeited. You can cancel or reschedule an appointment by emailing us at pawsandtrain.au@gmail.com, texting or calling on 0402543945.

Due to a change of mind or circumstance, we may, at our sole discretion, agree to provide a substitute service at a different time and/or place; however, you will not be entitled to a refund of the fee. We agree to provide you a refund of any monies paid by you should you elect to cancel your service 7 day prior the commencement of the program. If you fail to give us the required notice of 7 day prior, then all monies paid to us will be forfeited.

#2. Acknowledgment of dog’s Performance and Liability:

Although PAWS & TRAIN will use all reasonable care to train the owner’s dog, PAWS & TRAIN cannot guarantee to the owner that the dog will respond adequately to commands at all times. OWNER agrees that PAWS & TRAIN will not be liable for any damage or loss resulting from the dog’s failure to respond to any command(s) or behavior modification for which PAWS & TRAIN trained the dog.

PAWS & TRAIN agrees to train OWNER’S dog reasonably. However, the effectiveness of the completed training program depends upon many factors over which PAWS & TRAIN has no control. Such factors include, but are not limited to: the future health of the dog, the frequency and effectiveness of training reinforcement, which the OWNER must give the dog, and the degree of management and communication that the OWNER instills in the dog. Therefore, the owner is responsible for their dog(s) ultimate success.

I acknowledge that I have been informed and understand that there is always some unavoidable risk of injury involved when working with dog(s) and or animal(s), especially dog(s) and or animal(s) with behavioural issues. I understand that my dog(s) or animal(s) participation in PAWS & TRAIN services are not without some risk, that despite all the dog(s) or animal(s) appearing healthy, and being handled with the greatest amount of care and foresight, dog(s) and animal(s) are not always predictable and the unexpected may occur. I hereby assume any and all risks that would customarily and ordinarily occur by my participation in dog handling, dog movement or activities or services onsite, in your home, on the street, park, surrounding suburbs and consent to a release to the benefit of PAWS & TRAIN in consideration for my acceptance and participation in these services.

Understanding the above agreement, I voluntarily release PAWS & TRAIN from any and all liability of any nature. This includes any injury, death, sickness or damage that I or someone else may suffer during or after any PAWS & TRAIN services. I hereby accept and assume all risks associated with my dog(s) and or animal(s) attending this training including, but not limited to the risk of any and all injuries to myself, any dog(s) and or animal(s), members of my family, or guests who may attend, the risk that a dog(s) may cause injury to other persons and/or dog(s), and the risks that saliva, water, food, snow and/or debris may be present in the training, walking or sitting area.

I hereby waive and release of PAWS & TRAIN and owner(s) of any and all claims while on the grounds or surrounding areas/suburbs, and resulting from participation in PAWS & TRAIN including specifically, but without limitation, any injury or damage resulting from the action of any dog(s) or animal(s), including my own. I further agree to pay veterinary / medical expenses incurred as a result of injury caused by my dog(s) or animal(s).

#3. General Policy and Program Length:

Program sessions are conducted weekly unless the trainer has advised otherwise. Your training duration is directly related to how many sessions you acquire – one session = one week! As an example, the 6-unit program has a completion deadline of 6 weeks from the initial session.

Training

PAWS & TRAIN will endeavor to create as safe an environment as possible for the training of the Dog(s) identified above (the “Dog”), and will offer only sound, safe, and responsible training, care. Client understands that PAWS & TRAIN agrees to guide the owner and Dog on a lesson-by-lesson basis, the goal being to teach the owner how to train and work with Dog.

Owner agrees, however, that all animals may exhibit unpredictable behaviors and that PAWS & TRAIN will not be liable for the actions of the Dog that are outside of the control of PAWS & TRAIN. Owner agrees that any recommendations by PAWS & TRAIN of any method, tool, product or service is not a guarantee of dog’s performance.

The owner agrees to follow through on agreed instructions/methods and attend all pre-agreed sessions to achieve desired results. The Dog’s behavior is highly dependent on the Owner’s understanding of behaviour and application of techniques. The owner understands that he/she and members of the household must follow the trainer’s instructions, work with Dog daily as recommended, and continuously reinforce training to achieve desired goals. The student understands that any alteration of instructions/methods or inconsistency could negatively impact desired results.

#4. Tools and Products:

Owner fully understands different methods, tools, and techniques that may be used and recommended to train and modify the behaviour of their dog and agrees to the use of tools such as; Food/treats, Crates, Clickers, Muzzles, Flat Buckle collars, Tug/Puzzle toys, Flat collar, Harnesses, Leashes, Cardboard/Wood boxes, etc. PAWS & TRAIN is not required to provide any of these tools.

#5. Assumption of Risk and Property:

Although PAWS & TRAIN will use all reasonable care for your dog, we cannot guarantee beyond any doubt that the dog will be completely safe at all times, as all situations involve a measure of danger to any living thing. Your dog will be outdoors training and exercising in the real world. It is likely that your dog is going to get scratched, bumped, or bruised. Owner acknowledges the inherent and potential risk involved with interactions between humans and dogs, as well as between dogs and other dogs, which may result in property damage (leash, collar, etc.), or bodily injury, including but not limited to, permanent disability, sickness or death to human or dog; there may be other risks not known to you or PAWS & TRAIN, nor readily foreseeable at this time (collectively, “risks”).

You fully accept and assume all risks and responsibility including, without limitation, all losses, costs, and damages incurred as a result of your dog’s participation with PAWS & TRAIN, including any veterinarian expenses incurred on behalf of or caused by your dog to other people or dogs. “Sickness” includes any illness not limited to kennel cough, bloat, or any other form of contagious disease. As an Owner, you acknowledge and understand that there are certain risks involved in dog training. You release, indemnify, and agree to hold PAWS & TRAIN harmless from any and all manner of damages, claims, losses, liabilities, costs or expenses, causes of actions or suits, whatsoever in law or equity, (including, without limitation, attorney’s fees and related costs) arising out of or related to the services provided by PAWS & TRAIN.

PAWS & TRAIN will not be liable for any lost, stolen, or damaged personal property belonging either to you or your canine. If your canine causes any personal property damage to “T.H.D.T. Inc” property, another canine or otherwise, you will be liable for the full cost of all treatment, repairs, and replacements.

#6. Termination:

You agree that PAWS & TRAIN may, under certain circumstances and without prior notice, immediately terminate your registration of any service. PAWS & TRAIN may terminate any service for, but not be limited to, the following reasons; a breach or violation of this agreement or other incorporated agreements or guidelines; requests by law enforcement or other government agencies, a request by you, discontinuance or material modification to any service (or any part thereof) by us, unexpected issues or problems in us providing any service, non-payment of any fees owed by you in connection with the service. You agree that all terminations under this agreement will be made at our sole discretion and that we will not be liable to you or any third party for any termination of any services.

#7. Content (Photo/Audio/Video) Release:

I hereby assign and grant PAWS & TRAIN the right and permission to use, reproduce, distribute, and publish the photograph(s), film(s), videotape(s), audio and video recording(s), electronic representation(s) and/or sound recording(s) made of me and/or my dog(s) at any time during the training of my dog(s) by PAWS & TRAIN, and I hereby release PAWS & TRAIN from any and all liability resulting from such use, reproduction, distribution, and publication. I hereby authorise the reproduction, sale, distribution, copyright, exhibit, broadcast, and/or electronic storage of any and all such photograph(s), film(s), videotape(s), audio and video recording(s), electronic representation(s) and/or sound recording(s) without limitation at the discretion of PAWS & TRAIN and I specifically waive any right to any compensation I may have for any of the foregoing. By filling out this form, you have read these terms and agreed to this release Agreement.

#8. Communication and Contact between the owner and PAWS & TRAIN

Communication is primarily through email or text. If any questions should arise that are not addressed on the website,  PAWS & TRAIN will do their utmost to answer them via email or text message.

PAWS & TRAIN aims to respond to all messages within 24-48 hours via either email or text message.

I acknowledge that I am at least 18 years old, and have the right and ability to consent to the terms herein. I have read, understood, and agree to the terms of PAWS & TRAIN, dog training, dog walking & pet sitting consent/agreement form.
